DECATUR — A 51-year-old Decatur man was arrested Thursday morning on a preliminary charge of aggravated driving under the influence after a Decatur police officer discovered him asleep in a vehicle in a Walmart parking lot with a cup containing alcohol, police say. 

The officer made contact with the man shortly after midnight. The man was asleep in his truck and had his keys on his lap, according to a signed police affidavit. After the officer woke him up, the man drank from a cup inside the vehicle that he said had beer in it, police said. 

He also told officers he had two drinks before driving to Walmart around 8:30 p.m., and that he had been sitting in the vehicle since 9:30 p.m, the affidavit said. 

After smelling the odor of alcohol and observing the man having slurred speech and glassy, bloodshot eyes, the officer conducted a field sobriety test and a breathalyzer test, according to the affidavit. The latter showed the man had a blood alcohol content of .097, above the legal limit of .08. 

The man's driver's license was canceled in December because he had been convicted of a sex offense and not yet complied with the law requiring him to register as a sex offender, according to court records.
