DECATUR — Police said a Decatur man who attempted to punish his ex-girlfriend by posting a topless picture of her on social media is now facing a preliminary charge of the non-consensual dissemination of a private sexual image.

A sworn affidavit said Decatur Police officers were called to a home in the 1300 block of North Summit Avenue to investigate a domestic violence complaint Friday when they were told of threats to publish the picture.

The 27-year-old woman and mother of the 42-year-old man’s child said he made phone threats about posting the image. While police were on scene, a family member notified her that the man had posted the photo on Facebook.

Police later went to see the man, who admitted posting the image because he was “upset” with his former girlfriend. “He advised the photograph was only on Facebook for a couple of minutes before he deleted it,” the affidavit added. Police said the picture, which showed the woman sitting topless on a couch, was still stored on the man’s phone.

The man is free after posting $5,000 bond with the condition he has no contact with his ex-girlfriend. All preliminary charges are subject to review by the state attorney’s office.
