DECATUR — Police said it took a shot of pepper spray to stop a fight between an intoxicated man and his male neighbor after they got into an altercation over yelling into a cellphone.

A sworn affidavit from Decatur police said the incident happened Sunday night in the 1500 block of South Fairview Avenue — and the shot of pepper spray was administered by the neighbor’s mother. She targeted the intoxicated man, whom other neighbors described as the aggressor in the affidavit, and police said he was still trying to wash the spray out of his swollen eyes when officers arrived on scene at 9:55 p.m.

The neighbor who had been fighting with the 26-year-old suspect told police the trouble started while he was outside enjoying a cigarette and the suspect walked by, screaming into his phone. The neighbor told him to stop yelling because it was late, and he said the man then approached him “in an aggressive manner” and threw a punch at him and the fight was on.

“(The neighbor) said (the man) had him in a choke-hold, while on the ground, which is when his mother utilized pepper spray ... which quickly ended the fight,” said Police Officer Zach Wakeland.

The officer said the man refused medical treatment and kept saying he didn’t remember what had happened. “(He) appeared to be heavily intoxicated, having red, bloodshot eyes and speaking with slow and slurred speech,” added Wakeland. “(He) kept saying ‘He Maced me’ and ‘I should have (expletive) him up,’ and kept making statements of ‘beating his (expletive)’ when police leave.”

The man was jailed on a preliminary charge of assault but has since been freed after posting bond. Preliminary charges are subject to review by the state attorney’s office.
